What the 2026 India FCRA Amendment Means for Donors and Indian Nonprofits
On June 22, 2026, India amended the Foreign Contribution (Regulation) Rules, expanding reporting and compliance requirements for nonprofits receiving foreign funding. Below summarizes key changes.
India’s Ministry of Home Affairs made amendments to the Foreign Contribution (Regulation) Rules, 2011, effective June 22, 2026 – also known as FCRA. As a grantmaker to India, Myriad USA is tracking and reviewing these regulatory changes closely, including updating our due diligence process to support both our donors and nonprofit partners in navigating and staying compliant with the new requirements.
One notable change is that nonprofits in India receiving foreign contributions will be required to disclose donor information on every donation. Practically, this means anonymous donations are no longer allowed and Myriad USA will now require the donor’s name, email, and mailing address before accepting gifts intended for Indian grantees. For donations coming through donor advised fund sponsors, community foundations, or other intermediaries, the original donor’s information will need to be disclosed.
Indian nonprofits also face increased compliance requirements. While grants can still be made to India, additional regulatory reviews or approvals may extend grant processing times. Some of these key changes include:
- New definitions and restrictions of “Key Functionaries” who exercise effective control over the management and affairs of the nonprofit
- A requirement to specify the purpose for and the state(s) or Union Territory in which they intend to operate, including fees for additional locations
- Minimums on foreign contributions utilized over two financial years for FCRA renewal
- Disclosure of social media accounts
